These Terms of Service govern your use of shop.prodigyboats.com and your purchase of products from Prodigy Boats, LLC. By placing an order or using this site, you agree to these terms.

Eligibility

You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order. We ship within the United States only.

Orders and acceptance

Submitting an order is an offer to buy. Your order is accepted when we send a shipping confirmation, not when you receive an order confirmation email. We may decline or cancel any order, in whole or in part, including after an order confirmation has been sent. Reasons include product unavailability, a pricing or description error, a suspected fraudulent or unauthorized transaction, or an order that appears to be for resale. If we cancel an order you have already paid for, we refund it in full.

Pricing and errors

Prices are in US dollars and are subject to change without notice. We work to keep prices, descriptions, specifications, and images accurate, but this site may contain errors. A mistakenly posted price, option, or description does not obligate us to honor it. If an item's correct price is higher than the posted price, we will contact you before shipping and give you the choice to confirm at the corrected price or cancel for a full refund.

Product information

Specifications, fitment notes, and performance claims for products we resell are supplied by the manufacturer or distributor and are not independently verified by us. Confirm fitment and suitability for your application before ordering. Colors shown on screen may differ from the physical product.

Payment and tax

We accept the payment methods shown at checkout. You represent that you are authorized to use the payment method you provide. Sales tax is charged where required by law based on your shipping address.

Backorders

If an item is unavailable, we will notify you by email. If a shipment is expected more than 30 days after your order date, we will contact you and give you the option to cancel. Backorders are filled ahead of new orders when stock arrives.

Shipping, returns, and final sale

Shipping terms are set out in our Shipping Policy. Returns, exchanges, the return authorization requirement, the restocking fee, and the list of final sale categories are set out in our Refund Policy. Both are incorporated into these terms. Final sale items, including mud motor propellers, prop hardware, performance parts, clearance, made-to-order items, and services, cannot be returned or exchanged.

Risk of loss and title

Title and risk of loss pass to you when the carrier takes possession of your order. Claims for items damaged in transit should be reported to us within 7 days of delivery and we will handle the carrier claim.

Promotions and sweepstakes

Any sweepstakes, giveaway, contest, or promotion offered through this store is governed by its own official rules, which control over anything said on this site or in marketing material. Discount codes and promotional offers may be limited in time, quantity, and eligibility, cannot be combined unless stated, and have no cash value.

Digital products

Digital products are delivered electronically and are non-refundable once delivered, except where required by law.

Intellectual property

The Prodigy Boats name, logos, boat and product designs, photography, artwork, and site content are owned by Prodigy Boats, LLC or its licensors and are protected by copyright and trademark law. You may not copy, reproduce, or use them commercially without our written permission. Buying a product does not transfer any rights in the artwork or marks on it.

Content you submit

If you submit a review, photo, comment, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce it in connection with our business. You are responsible for having the rights to anything you submit. We may remove content at our discretion.

Acceptable use

Do not use this site to break the law, infringe anyone's rights, interfere with the site's operation, scrape or harvest data, attempt unauthorized access, or place fraudulent orders.

Third-party links

This site may link to third-party sites and services. We do not control them and are not responsible for their content, products, or privacy practices.

Warranties

Manufactured products carry the warranty, if any, offered by the manufacturer. Resold products carry only the original manufacturer's warranty. Except for any express written warranty we provide, products and this site are provided on an "as is" and "as available" basis, and we disclaim all other warranties to the maximum extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose.

Safety

Boats, mud motors, propellers, and related equipment are used in an environment with real risk. Install, operate, and maintain all products according to the manufacturer's instructions, follow all applicable boating and hunting regulations, and use appropriate safety equipment. You assume responsibility for safe installation and use.

Limitation of liability

To the maximum extent permitted by law, Prodigy Boats, LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of your use of this site or any product purchased through it. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these terms limits liability that cannot be limited under applicable law.

Indemnity

You agree to indemnify and hold harmless Prodigy Boats, LLC and its officers, employees, and agents from claims arising out of your misuse of this site, your violation of these terms, or your violation of the rights of a third party.

Governing law

These terms are governed by the laws of the State of Georgia, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Georgia, and you consent to that jurisdiction and venue.

Privacy

Our Privacy Policy explains how we handle your information and is incorporated into these terms.

Changes

We may update these terms at any time by posting a revised version on this page. The terms in effect on the date you place an order govern that order.

Severability

If any provision of these terms is found unenforceable, the rest remain in effect.
